Luigi Mangione’s lawyers filed paperwork on Friday once again pushing for dismissal of his state-level case in the killing of UnitedHealthcare executive Brian Thompson following his federal guilty plea.
Mangione pleaded guilty on 14 August to federal charges in Thompson’s grisly death outside a Manhattan hotel on 4 December 2024. The shocking plea came less than a month before his state murder and weapons trial, which had been scheduled for 8 September.
Thompson’s death spurred a sprawling search for his killer. The incident simultaneously elicited an onslaught of anger against the for-profit US healthcare industry, which has long been decried for putting their bottom line ahead of patients, to the latter’s detriment.
About an hour after Mangione admitted to two federal stalking charges, his lawyers filed paperwork to dismiss his state case. They have contended that New York state’s double jeopardy laws bar him from being prosecuted by the Manhattan district attorney.
Double-jeopardy protection under the US constitution does not bar state prosecution for the same crimes as a federal case, and vice-versa. However, New York state statute maintains that “a person may not be twice prosecuted for the same offense” and “a person may not be separately prosecuted for two offenses based upon the same act or criminal transaction”.
Thompson’s grizzly death
Maybe I don’t understand what that word means, but I never found anything about what I saw in that video to be even close to “grizzly.”
I wouldn’t use that word to describe what happened.
I think personally that Brian Thompson was asking for it based on the clothing he was wearing at the time, and the demeanor he had. It’s a known fact that when a real masculine alpha male man like Luigi Mangione sees a literal slug in human form slithering around there is an instinctual need to shoot it. So I don’t see why he should have such a promising life ruined over this mans decisions. Like sure, it’s sad and all, and our thoughts go out to his family or whatever, but the more important thing is making sure Luigi can still get a nice paying job. Maybe he could do some community service?
So, what you’re saying is that we shouldn’t ruin a promising young man’s future for just 20 seconds of action?
That sounds fair.
damn I forgot how bad that line was fine here’s my upvote
Still haunts me to this day someone tried to defend a convicted rapist with that phrase
A health insurance executive is a direct threat to my well-being and I have the right to stand my ground.
You are such a brave patriot. Stay strong. He might be unarmed, and you might have a fully automatic shoulder mounted machinegun, but don’t let that fool you, your life is in danger.
The CEO murdered families and children. Don’t be fooled.
I don’t think you got the joke.
I could slip off the curb trying to get away from him, hit my head, and end up with so much debt I kill myself.
Clearly a direct threat.
With the state charges gone, if he were convicted of federal charges alone then a future president could pardon him.
Yeah, that’s not going to happen. Maybe 100 years from now. IF the political winds blow from a particular direction. And by then no one will remember or care.
Separate soverigns = seperate charges.
They should dismiss all charges. I personally know of at least 10 people that an vouch for his whereabouts during the week of the shooting.
Thompson didn’t die a grizzly death. It was quick and clean. Customers of United health on the other hand die in agonizing pain and hopelessness as they spend their last few months on this planet waiting to receive life saving care that they pay for, only to learn the treatment has been denied.
Sure, go ahead and appeal. If and when you win it will be too late anyway, which is exactly what they want.
This was written by the rich to make regular people angry. The article misses the broad public support for Luigi or his actions and the sudden reversal of inhumane policies by other healthcare organizations. This shit works.
Those bullet wounds were clearly a preexisting condition
Ofc, the CEO presented with gunshot wounds just before death.
Q: How long does pre-existing needs to be? A: Please hold. Your call is important for us <2 hour music loop>
Free Luigi.
If I was elected president, I would pardon him.
Not until the state charges are dropped. Then, yeah, openly declare the health insurance industry a clear and present danger to the health and safety of all Americans, extend Medicare to all, pardon Luigi, and declare hunting season on everyone with more than $10 million in registered securities, no bag limit.
Dropped with prejudice (preventing them from being restarted) or else dropping the federal case means they can just go ahead again.
(either way he’s probably better off in state court than federal)
OwOarchist 2028!
Oh neat, I’ve always wanted a Luigi
“grisly death” lol what. Put the bias away, guardian.
Right? Getting shot is like the regular old most American way to die. Geez, dramatic much?
I mean, if its good enough for our schoolchildren…
Deserved a grizzly death to be honest. Light mauling, some chomping, the usual.
Yeah.
His death was way less grisly than the deaths that United Health Care forces its customers to endure.
Members*, it’s customers are employers
How do we know Brian thompson didn’t just fall on that bullet?
edit: 1 downvote? I think Brian Thompson faked his death.
Luigi did nothing wrong
Not only did Luigi do nothing wrong, the guy who actually did it did nothing wrong either
And neither of them could have done it because they were at my house hanging out when it happened.
Getting caught was kind of a blunder, but other than that…
he was framed for a crime he did not commit
Did they ever find the person who snitched on him?
Wasn’t it one of the McDonald’s workers, who then ended up getting fired because they brought too much attention to the McDonald’s?
Well if they got paid the reward then they probably don’t mind not working at Mickey D’s anymore.
they did not get paid.
Womp womp
Then again: is that confirmed? If I were the snitch I’d want people to think I didn’t get paid too
Murder is bad. Perhaps the most bad. Let’s keep it in perspective though, it was just a greedy white money guy that got killed. They’re a dime a dozen and nothing special. /s
I hope they find the true killer.
I don’t. I just want Luigi acquitted.
New York state statute maintains that “a person may not be twice prosecuted for the same offense”
Then what’s the fucking problem?
Holy shit, the law field is utterly fucked.
Double jeopardy doesn’t attach until there is a final disposition in one of the actions.
And it also doesn’t apply to charges in multiple courts: state, federal, military.
